1. ACCEPTANCE OF TERMS
These Terms of Service ("Terms") govern your access to and use of DailyRep, including our website at dailyrep.app, mobile applications, and all related services (collectively, "the Service"). By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy.
If you do not agree to these Terms, do not use the Service.
2. ELIGIBILITY
You must be at least 13 years old to use DailyRep. By using the Service, you represent that you are 13 or older. If you are between 13 and 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
Users in jurisdictions with a higher age of digital consent must meet that requirement.
3. YOUR ACCOUNT
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at hello@dailyrep.app if you suspect unauthorized access.
You may not create accounts on behalf of others, use another person's account, or create multiple accounts to circumvent restrictions.
4. ACCEPTABLE USE
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws or regulations
- Attempt to gain unauthorized access to any part of the Service or its infrastructure
- Reverse engineer, decompile, or disassemble any part of the Service
- Scrape, crawl, or otherwise extract data from the Service in bulk without permission
- Impersonate any person or entity or misrepresent your affiliation with any person or entity
- Upload or transmit any content that is unlawful, harmful, abusive, harassing, or otherwise objectionable
- Use the Service to spam or send unsolicited commercial communications
5. YOUR CONTENT
You retain ownership of the content you create in DailyRep — your habits, activities, notes, and profile information. By using the Service, you grant DailyRep a limited, non-exclusive license to store and display your content solely to provide the Service to you.
We do not claim ownership of your data. You can export or delete your content at any time.
6. SUBSCRIPTIONS AND PAYMENTS
DailyRep currently offers a free tier. When a paid subscription tier becomes available, the following terms will apply:
- Subscriptions will be billed on a recurring basis (monthly or annually) as selected at purchase
- Payments are processed by Apple (App Store) or Google (Google Play) — we do not store your payment information
- You may cancel your subscription at any time through your App Store or Google Play account settings; cancellation takes effect at the end of the current billing period
- Refunds are governed by the refund policies of Apple or Google, as applicable
We reserve the right to change subscription pricing with reasonable advance notice.
7. INTELLECTUAL PROPERTY
The DailyRep name, logo, app design, and all content we create — including text, graphics, and software — are owned by or licensed to DailyRep and protected by applicable intellectual property laws. You may not use our branding or content without our prior written permission.
8. DISCLAIMERS
DailyRep is a habit tracking tool, not a medical, fitness, or nutritional service. Nothing in the app constitutes professional athletic, medical, or health advice. Consult qualified professionals for personalized guidance.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or free of harmful components.
9. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, DailyRep and its owners, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or loss of goodwill, arising out of or related to your use of or inability to use the Service.
Our total liability to you for any claim arising from or related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim, or $10 USD, whichever is greater.
10. INDEMNIFICATION
You agree to indemnify and hold harmless DailyRep and its team from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.
11. TERMINATION
You may stop using DailyRep and delete your account at any time. We may suspend or terminate your access if you violate these Terms, with or without notice, depending on the severity of the violation.
Upon termination, your right to use the Service ends immediately. Sections 7, 8, 9, 10, and 12 survive termination.
12. GOVERNING LAW
These Terms are governed by the laws of the State of Oregon, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts located in Oregon, and you consent to personal jurisdiction there.
If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
13. CHANGES TO THESE TERMS
We may update these Terms from time to time. When we make material changes, we will notify you by email or via an in-app notice at least 14 days before the changes take effect. Continued use of the Service after that date constitutes your acceptance of the revised Terms.
